The = Fair Work=20 Act and = Small=20 Businesses

From 1 = January=20 2010 Australians are governed by a new national workplace = relations=20 system, The Fair Work Act.  = The changes in workplace laws affect all employers and=20 employees.  The key = elements=20 of The Fair Work Act are the introduction = of:

  • National = Employment=20 Standards=20
  • Introduction of = Modern=20 Awards=20
  • Revised enterprise = bargaining arrangements=20
  • Streamlined = protections=20 dealing with workplace rights, industrial activities and unfair=20 dismissal=20
  • Two new agencies = to regulate=20 the system =96 Fair Work Australia and the Fair Work=20 Ombudsman

These = key=20 elements may mean significant changes for your small = business.  The National Employment = Standards=20 are comprised of 10 minimum standards of employment, covering = minimum=20 entitlements regarding:

  1. Minimum weekly = hours of=20 work=20
  2. Requests for = flexible=20 working arrangements=20
  3. Parental leave and = related=20 entitlements=20
  4. Annual=20 leave=20
  5. Personal/carer=92s = leave and=20 compassionate leave=20
  6. Community service=20 leave=20
  7. Long service=20 leave=20
  8. Public=20 holidays=20
  9. Notice of = termination and=20 redundancy pay=20
  10. Provision of a = Fair Work=20 Information Sheet

The = Modern Awards=20 replace the existing awards in most industries and apply in = addition to=20 the National Employment Standards. =20

Donations

Various = appeals=20 have been launched to help the people of Haiti=20 devastated by earthquake on 12 January, but how do you know that = the=20 organisation collecting the donations are legitimate?

Only = donations to=20 certain types of organisations are tax deductible.  These organisations must = be a=20 Deductible Gift Recipient (DGR) on the Australian Business = Register.  You can check if an = organisation=20 is a DGR by searching the ABN or organisation name at www.abn.business.gov.au.  There is no tax = deduction for=20 donations to overseas charities which are not DGR=92s in = Australia.=

Australians=20 Working Overseas

Are = considering=20 working overseas?  = There are=20 many things that you have to consider in regards to the tax=20 implications.  You = will need=20 to take into account the tax laws of the country you will be = working in,=20 along with your residency status. =20

Australian=20 residents are taxed on their worldwide income. This page outlines = the tax=20 implications in Australia if you are = working or=20 thinking about working overseas. =20 If you are going to remain an Australian resident, you must = still=20 lodge an Australian Income Tax Return, reporting your world wide=20 income.  In this = instance, you=20 may be eligible to claim a foreign income tax=20 offset.

If you = will no=20 longer be an Australian resident, but still earning an Australian = income,=20 you may still have to lodge an Australian Income Tax Return if you = have=20 not had non-resident withholding tax deducted from your.

Should = you decide=20 that you will no longer be an Australian resident and will not be = earning=20 income from any Australian source, you will not have to lodge an=20 Australian Income Tax Return and the tax laws of the country you = are=20 working in would apply.
